New permitted development rights for commercial property

From 1 August 2021 there will be a change to permitted development rights whereby if certain conditions are met, unused commercial buildings can be converted into residential dwellings.

This will be referred as the new business use class MA and the conditions that need to be met will include:

  1. The building must have remained unoccupied for 3 months prior to an application for its change being made;
  2. The total space must not be larger than 1,500m2
  3. The building must previously have been in business use class E for at least 2 years

There are also certain restrictions on this use class as it is not available in areas of Outstanding Natural Beauty, National Parks and for Listed Buildings.
