Case Study

Abandonment of Vehicle:

Nathan Taylor-Allkins successfully represented a client charged with abandoning a trailer contrary to Section 2 of the Refuse Disposal (Amenity) Act 1978. The client’s trailer, which had been left in a parking bay mistakenly believed to belong to a friend, had been removed and destroyed by a local Council and prosecution proceedings were then instigated.

The offence carried with it the risk of a three month custodial sentence together with the threat of significant prosecution costs if convicted.

Following detailed representations, the prosecution dropped the case the day before the trial resulting in the client’s rightful acquittal and avoiding having to pay any costs for the removal and destruction of the trailer.
